Terms of Service

Please read these Terms of Service carefully before using the MotorMatch platform. These terms, together with our Privacy Policy, govern your access to and use of our services.
1. Acceptance of Terms
By accessing or using the MotorMatch website at motormatch.ca or the MotorMatch mobile apps for iOS and Android (collectively, the "Platform") you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old and a resident of Canada to use the Platform. By creating an account you represent that you meet these requirements.
3. Use of the Platform
You may use the Platform solely for lawful purposes related to buying, selling, or browsing vehicle listings in Canada. You will not post false, misleading, or fraudulent listings; harass, abuse, or harm other users; collect personal information without consent; interfere with the Platform's infrastructure; or violate any applicable federal, provincial, or local law.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
5. Vehicle Listings
Sellers are solely responsible for the accuracy and completeness of their listings, including descriptions, pricing, images, and vehicle history. MotorMatch does not verify listings and makes no guarantees regarding the condition, legality, or safety of any vehicle listed. All transactions are between the buyer and seller; MotorMatch is not a party to any sale.
6. Dealer Accounts
Dealers must hold valid dealer licences as required by their province or territory. Dealer accounts are subject to additional terms including listing volume limits, response-time expectations, and compliance with applicable consumer-protection regulations.
7. Fees, Payments, and AI Token Bundles
Some features require payment. All prices are in Canadian dollars and subject to applicable taxes. On the web, payments are processed by Stripe. On the iOS and Android apps, AI token bundles are sold through Apple's App Store and Google Play Billing respectively; those purchases are subject to Apple's and Google's terms in addition to ours. Tokens are non-refundable digital credits used to unlock AI tools inside the Platform. Subscription fees are billed in advance and may be cancelled at any time, but refunds are governed by our refund policy and, for App Store / Google Play purchases, by the respective platform's refund process.
8. Electronic Communications and CASL
By creating an account you consent to receive transactional notifications related to your use of the Platform (account verification, password reset, buyer messages, listing status, price-drop alerts you asked for, etc.) by email and push notification. Marketing notifications — promotional emails, product announcements, recommended listings, the newsletter — are only sent with your express opt-in consent under Canada's Anti-Spam Legislation (CASL). You can grant or withdraw consent at any time in Settings → Notifications; withdrawal takes effect within 10 business days.
9. Privacy
Our handling of your personal information is described in our Privacy Policy at motormatch.ca/privacy. By using the Platform you acknowledge that policy. You may request access, correction, or deletion of your personal information at any time per the procedures in the Privacy Policy.
10. Account Deletion
You may delete your account at any time in the app (Settings → Account → Delete account) or at motormatch.ca/account-deletion. A 14-day grace period applies; after that we anonymise or delete your personal information as described in the Privacy Policy. Some records (financial, tax, anti-fraud) must be retained for limited periods as permitted or required by law.
11. Intellectual Property
All content on the Platform is owned by MotorMatch or its content suppliers and is protected by Canadian and international copyright laws. You retain ownership of the content you submit (listing photos, descriptions, messages) but grant MotorMatch a non-exclusive, worldwide, royalty-free licence to host, display, and distribute it for the purpose of operating the Platform.
12. Limitation of Liability
MotorMatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to MotorMatch in the twelve months preceding the claim. The Platform is provided "as is" without warranties of any kind.
13. Dispute Resolution
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association. The arbitration shall take place in Toronto, Ontario, and the language of arbitration shall be English.
14. Changes to Terms
MotorMatch may modify these Terms at any time. We will notify users of material changes by email and in-app banner at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
